The Mid-South District of the Lutheran Church Missouri Synod (“Mid-South District”) out of respect for your individual interests in the protection of your personal information provides the following Terms and Conditions (T&C) related to use of its website https://midsouthdist.goodbarber.app and/or on our application Mid-South District.

 

Navigating and/or interacting on our website and/or application means that you expressly agree to these T&C without reserve or objection.

Mid-South District has the right to modify or to adapt these T&C at any time and without prior notice. These T&C are directly applicable as soon as they are published on our website and/or application and/or sent to you by any means.

Please read these T&C carefully before using, interacting or accessing our website and/or application.

By agreeing to these T&C you grant us that you have reached at least the legal majority in your country, state or province of residence. If you are a minor you grant us that you have all the rights and consent from your legal representatives to use our services. If you have not reached the legal majority then you must not use our Services.

You are not entitled to use our services, website and/or application for any illegal or unauthorized purposes.

You must not try to hack, alter the use or functions of our services, send viruses or lead or try to lead any other kind of attack towards our services. You must not try to attempt at our services' integrity either.

The content to include images and video, provided in our Services might be accessible for free or not. Some content to include images and video, might be required to be logged in or to have a valid paid subscription (IAP, restricted contents or sections).

The contents, to include images and video, of our Services are intended for personal, non-commercial use. All materials, to include images and video, available on our Services are protected by copyrights and/or intellectual property rights.

In addition to that, some content, to include images and video, might be protected by some other rights such as, trademark, patents, trade secrets, database right, sui generis rights and other intellectual or proprietary rights.

The user of our Services is not allowed to reproduce totally or partially any content to include images and video, that is made available through our Services. The user will also not reproduce any of our logo, name, visual identity and so on, he will also not try to reproduce, copy or produce copy of our Services.

Warranties

The content to include images and video, provided by our Services is provided to the user as it is and we cannot guarantee that the content provided will be exact, true, or error-free. The user accesses our content at its own risks.

We will not be held responsible if any content on our Services is inaccurate or mistaken.

Content moderation (chat, comments and others) and user generated content

If our user uploads, posts or submits any type of content to include images and video, on the Services you represent to us that you have all the necessary legal rights to upload, post or submit such content.

You shall not publish, distribute or upload any content that is, abusive, fake news, obscene, pornographic, illegal.

In addition to that you shall not try to impersonate anyone else or use a fake identity in order to use, access or publish any content to include images and video on our Services.

You shall not use our Services to transmit any kind of malware, viruses, crypto lockers, ransomware or spyware.

Users will not threaten or verbally abuse other users nor will they spam the Services. User will use respectful language, you will not try to abuse or discriminate based on race, religion, nationality, sexual gender or preference, age, disability and so on. Hate speech is prohibited.

Our Company has the right to delete, modify, censor and delete a client’s content to include images and video, or account if any of the rules above are violated. This will be done without any prior justification or notice. The client will not receive any compensation.

Liability

Our company will not be liable in case of network disruption, viruses, outside access, fraudulent use of payment methods or any other kind or type of technical issue or fraudulent access.

 

Third-Party links and external links

Some of the content, to include images and video available on our website and/or application can include materials from third-parties and outside sources. Third-party links on our websites and/or applications can direct you to outside of our control websites that are not affiliated with us. We are not responsible nor liable for controlling or examining the content or accuracy of third-party websites or outside sources.

Hence, we are not liable nor responsible for any damages or misuse while accessing third-party links or external links or sources on our website and/or application.

Disclaimer of warranties

While using our website and/or application you grant us that we will not be held liable or responsible if data on our services is not accurate, true, complete or correct. Our company reserves the right to modify and/or delete any content to include images and video on our services without prior notice, but our company has no obligation to update any content available on our services.

Our services are delivered and provided to clients as is for use, without any warranties or conditions of any kind.

In no case shall our company’s staff, employees, personnel, agents, interns and so on, be liable for any loss, claim, injury, any indirect or direct damage, incidental, punitive or special damages of any kind or type. This includes loss of profits, lots of revenues, lots of data or savings, whether based on tort law, contract, liability or otherwise.

Indemnification

You as a client of our company agree to indemnify, defend and hold us harmless from any claim or demand, this includes attorney’s fee made by any third-party due to your breach of these T&C or any other document that is binding between you and our company.

 

Severability

If any part, article or document of these T&C or of any other binding document between you and our company is determined by a competent jurisdiction to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

The unenforceable portion shall be deemed to be severed from these T&C such determination will not affect the validity and enforceability of any other remaining provisions.

Termination

All of the obligations and liabilities of the parties that occurred before the termination date shall survive the termination of this agreement.

These T&C are effective unless terminated either by our company or by the client.

The client can notify our company that he no longer wants to use our services or he can simply stop using and/or access our services, websites and/or application.

Our company can terminate this agreement at its sole discretion at any time and without prior notice, the client will hence remain liable for any remaining amounts due to our company.

Governing Law and Venue

The present T&C are ruled by the laws of the State of Tennessee.

Any issue arising from these T&C regarding, but not limited to, their validity, interpretation, execution, consequences and so on will be pleaded in front of the relevant jurisdiction.

The relevant jurisdiction and venue is any federal or state Court in Shelby County, Tennessee.

Scope of the Privacy Policy

This privacy policy covers Mid-South District’s treatment of personally identifiable information that may be collected while you are on Mid-South District’s website, app, when you make donations through the site or app, or that is shared with Mid-South District by its partners.  This policy does not apply to the practices of companies not owned or controlled by Mid-South District or to people who Mid-South District does not employ or manage, nor does it address non-personally identifiable information. If, while using Mid-South’s site or app, you should ever transfer or link to an outside party’s site or app, Mid-South strongly encourages a review of the outside party’s privacy policy before you continue such use.  Mid-South District’s Privacy Policy specifically addresses the following areas:

Information Collection and Use

Mid-South District is the sole owner of the information collected on its site and/or app.  Mid-South District may collect information from you at two different stages.  First, we collect anonymous, aggregate information from all visitors to the site. This information is never linked to any personally identifiable information and is only used to generate general statistical reports about the use of our site. Second, Mid-South District collects personally identifiable information when you create a Mid-South District account or utilize certain services. Online account creation may require you to submit the following personal information:  name, address, company information, email address, and phone number.  For purposes of billing for donations or other giving, you may need to provide your credit card type, number, expiration date and billing address for the credit card.  If using other payment types, if available, other financial information may be required to include personal or business banking information.  Certain personally identifiable information is required if you subscribe to a Mid-South District newsletter or sign up to participate in a promotion, event, survey or other gathering through the site. Mid-South District may also receive personally identifiable information from our partners.  We strongly recommend that anyone under the age of 18 receive permission from their parent or legal guardian before providing any personal information to Mid-South District’s site or app.  Mid-South District would request that nobody provides any personal information of another to its site or app without express permission to do so.

 

Your Disclosure to Third Parties

To the extent you include personal data in your submissions (such as your email address, phone number, images and/or video), third parties may be able to identify you, associate you with your user account, and contact you.  Please do not include information in your submissions that you expect to keep private.  Please also note that any personal messages you send or receive using any Mid-South District site or app messaging feature, if available, are only private to the extent that you and the sender keep them private. Mid-South District would have no control over whether a recipient of one of your personal messages publicly posts the contents of such a message.   For all of the foregoing reasons, Mid-South District would again state that no personal information to include images or video of any other party should be provided without that party’s express consent.

 

Personal Information Not Collected From You

Mid-South District may have received your personal information to include images or video from other persons.  Mid-South District may use your personal information to communicate with you.  If you did not directly provide us with your personal information, please contact us using the contact information below if you would like your personal information removed.

 

Location based Information

To understand the location of its users Mid-South District may use, where available, GPS, IP addresses, Wi-Fi hotspot, cell tower, and other technologies to determine the location of the device used to access the site or app.  Unless you provide consent, this location data is collected anonymously in a form that does not allow for identification of any specific individual.

Information Regarding Children

Mid-South District takes very seriously the safety and security of children and to that end requires extra precautions be taken to protect the safety of children as it relates to the use of its site and app.  Children under the age of 18 are not allowed to create their own accounts or provide any personal information to include images and video, unless their parent or legal guardian has provided verifiable consent.  Similarly, no photographs, videos or other identifiable items which may reveal personal information regarding a child under the age of 18 shall be provided to or used on Mid-South District site or app without verifiable consent by each child’s parent or legal guardian.  Such consent should be obtained at the time of the photograph, image, video or other identifying item and retained for review or verification at any time during the use of the image, which may reveal personal information.  If it is learned that Mid-South District has been provided or otherwise collected any personal information of a child under the age of 18 steps will be taken to remove the information or image as soon as possible.  If at any time a parent or legal guardian needs to access, correct, or delete any such data please contact Mid-South District using the contact information below.

 

Profile

We store information that we collect through cookies, log files, and other means to create a profile of our site visitors.  A profile is stored information detailing how individual visitors use the site.  Collected information in a profile is tied to the user’s personally identifiable information to include images and video.  However, your profile is used solely for internal purposes.  Mid-South District does not share your profile with any third party.

This site/app may contain links to other sites.  Mid-South District is not responsible for the privacy policies or practices or content of these other sites.  When you leave Mid-South District’s site, or view another site through Mid-South District’s site, you are strongly encouraged to read the privacy policy of each other site.  This Privacy Policy only applies solely to information gathered by Mid-South District.

 

Security

It is the intention of Mid-South District to take all reasonable and appropriate steps to protect the personal information, to include images and video, of its users.  Given the nature of the internet, however, there are no infallible security measures and the total security of your personal information cannot be guaranteed.  When registering for access to a secure area of the site or app you may be asked to provide a username and password.  Should that be required we would recommend not sharing that information to further secure your personal information.
